Pursuant to Article 13 of the Regulation (EU) 2016/679 of April 27, 2016, on the protection of personal data (hereinafter “GDPR”), please be informed that the information provided by you (name, surnames, email, date of birth, gender, telephone number and postal code), as well as that obtained from your devices (MAC address, positioning data and circulation flow), will remain under the responsibility of FLAME ANALYTICS, S.L., responsible for the processing, company with Tax ID Number B52543691 and registered office at Espacio Tecnológico Molinón, El Molinón 100, C.P. 33203 Gijón (Asturias), which can be contacted by telephone (+34) 984 19 14 05 or via its email address info@flameanalytics.com.

You are also informed that FLAME ANALYTICS, S.L. (hereinafter “FLAME”) has appointed a representative for matters related to personal data protection, who can be contacted to exercise your rights at the email address privacy@flameanalytics.com.

Purposes of processing

In order to access the service, the user must accept all the purposes for which it was created since the benefits derived from them help the establishment from which you have connected to the service in covering the costs resulting from the access service to the WiFi network

In order to use this WiFi access service, it is necessary to collect personal contact information which is requested in the registration form and through social networks. Therefore, please be informed that by sending the aforementioned data, you are AWARE and ACCEPT that FLAME collects and processes your personal data, MAC address and the positioning data and circulation flow generated by your mobile devices resulting from their movements within the premises. Collecting this data is necessary for the following purposes:

  • For statistical studies conducted by FLAME and the establishment from which you have connected to the service.
  • For sending by email the newsletter of the establishment from which you have connected to the service as well as send commercial communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, that enable commercial communications. These commercial communications may be related to products or services offered by the establishment from where the connection to the service was made, or with commercial communications and services offered by the collaborators or partners with whom the establishment where the connection to the service was made reaches a commercial promotion agreement among its clients on the offers and services offered by these collaborators or partners.

The USER can unsubscribe from being sent commercial communications through the option provided in each of the communications addressed to him/her by clicking on the section to opt-out from receiving all emails sent by the establishment from which the user has connected to the service. Unsubscribing from the communications automatically leads to the cancellation of the SERVICE since the processing of data for commercial purposes is considered as remuneration for the service provided.

We will keep your personal information for three years or until the user requests its erasure.

Legitimacy for processing

The WiFi internet service allows the user to have a free internet connection. In order to use it, the user must voluntarily provide the information, or log in through a social network, and explicitly accept the purposes of the processing and these conditions.

Failure to submit the requested information or explicit non-acceptance of these conditions will result in the inability to provide you with the WiFi internet service.

Recipients of the data

Personal data will be transmitted to the establishment where you have connected to the service and will be used only for the purposes described in section 2.

Rights of the interested party

Any user has the right to obtain confirmation as to whether FLAME is processing his/her personal data.

The user has the right to access personal data concerning him/her and to request for the rectification of inaccurate data or, where appropriate, request its erasure when, among other reasons, the data is no longer necessary for the purposes of collection.

Under certain circumstances, the user may request a restriction on the processing of their data, in which case such data will only be retained for the establishment, exercise or defence of legal claims.

Similarly, for reasons related to his/her particular situation, the interested party may object to the processing of his/her personal data. In this case, FLAME will stop processing the data, and delete it, except in the event of compelling legitimate grounds or for the establishment, exercise or defence of legal claims.

Similarly, you may request the portability of your personal data, in which case the data will be transmitted from FLAME to the person responsible for the requested processing, when technically feasible.

To exercise the right to modify your data and/or cancel commercial communications a portal has been made available and can be accessed at the following URL: https://portal.flameanalytics.com.

In order to exercise any other right, the user must send a request including the interested party’s name and surname, a copy of his/her National ID card (DNI) and, in those cases where it is admitted, his/her representative, along with accrediting documents of the representation; the petition in which the request is specified, address for the purposes of notifications, date and signature of the applicant and the supporting documents of the petition being made. All this information must be sent to our representative.

No charge whatsoever will be made for exercising these rights, in accordance with the terms established in the applicable regulations which can be consulted at this link: www.agpd.es.

The interested party may withdraw his/her consent to the aforementioned purposes set out above at any time.

Additionally, the interested party has the right to file a complaint with the Spanish Data Protection Agency (AEPD) through the AEPD complaints reporting service; especially if he/she has not obtained satisfaction in the exercise of his/her rights.

Session cookies: Internal use of the application server. Variable with the session ID of the user and the node to which his/her session has been assigned.

Security measures

FLAME has adopted the necessary security measures so that your personal data is not compromised.

Similarly, please be informed that your data is stored in a provider which belongs to the European Union with which FLAME holds a contract that ensures full compliance on the part of the provider with the current legislation on personal data protection.
